These Terms of Use (the "Terms") govern your use of our self-assessment mobile apps for iOS and Android (the "Screening Apps"), our related websites, and any associated services (collectively, the "Services"). They apply to every Screening App published by Elomia Health, Inc. By downloading, accessing or using any part of the Services, you agree to be bound by these Terms and enter into a legally binding contract with us. Please read them carefully. If you do not agree, do not use the Services.

The Screening Apps
Each Screening App provides one self-assessment questionnaire. These questionnaires are established screening instruments developed by researchers and clinicians and published in the scientific literature. The app presents the questionnaire, calculates your score using its published scoring rules, explains what the score range generally means, stores your results on your device so you can see how they change over time, and lets you export or share your results.
Please keep in mind that:
- The Screening Apps are not a medical device and do not provide medical advice. They are informational and educational tools for general wellness and self-reflection.
- The Screening Apps cannot diagnose any disease, disorder or condition. A screening questionnaire indicates whether your answers fall in a range that researchers and clinicians associate with a condition. Only a qualified healthcare professional can make a diagnosis, and a score alone is never enough to do so.
- A low score does not rule anything out, and a high score does not confirm anything. Screening instruments produce both false positives and false negatives.
- If you think you may have a mental-health condition, please consult a physician or mental-health professional. Do not use the Services as a substitute for professional advice, diagnosis, treatment or prescribed medication. You are welcome to use the Screening Apps alongside professional care, for example by sharing your results with your clinician, but they cannot replace it.
Questionnaires completed about another person. Some Screening Apps are designed for a parent or carer to complete about a child. If you use such an app, you confirm that you are the child's parent or legal guardian, or are completing it with their permission, and you understand that the result is a screening indicator to discuss with a healthcare or education professional, not a diagnosis.
Emergency Resources
The Services are NOT intended for emergencies or crisis support.
If you are experiencing a mental-health crisis, are at risk of harming yourself or others, or are in immediate danger, please call 911 (in the United States) or your local emergency number.
In the United States you can call or text 988, the Suicide and Crisis Lifeline, or chat at 988lifeline.org. You may also contact local community services by calling 211 or visiting 211.org. Outside the United States, please refer to Suicide.org for local helplines.
Some questionnaires include questions about self-harm. If you answer such a question in a way that indicates risk, the app will show you crisis resources. This is an automatic message based on your answer; no person reviews your answers, and no one will contact you.

We cannot answer questions about your health, symptoms or results. Please take those to a qualified healthcare professional.
Accessing the Services
The Screening Apps are available on the App Store and Google Play. They are free to download and use.
No account is required. You do not need to register or provide any personal information to use a Screening App. Your answers and results are stored on your device.
Reminders. You may choose to receive reminders to retake the questionnaire. Push notifications and reminders in your device's Reminders app do not require any personal information. Email, calendar, SMS and phone-call reminders require an email address or phone number, which we use only for that purpose. You may turn any reminder off at any time in Settings. Standard carrier rates may apply to SMS and calls.
Deleting your data. You may delete all data at any time in Settings. This erases your answers, history and settings from your device and instructs us to delete any reminder contact details we hold. Deletion is immediate and cannot be undone.
Eligibility. The Screening Apps are intended for people aged 16 or over. A parent or carer may use an app designed for completion about a child. If you are under 16, please do not use the Services.
Children's Privacy
Under the Children's Online Privacy Protection Act (COPPA), online service providers must obtain parental consent before knowingly collecting personally identifiable information from children under 13. We do not knowingly collect or request personal information from children under 13, and Screening Apps completed about a child collect no information from the child. If you believe a child under 13 has provided us with personal information, contact support@elomia.com and we will delete it.
Prohibited Uses
You may not:
- Use the Services to diagnose, treat or make clinical decisions about yourself or another person, or represent results from the Services as a diagnosis
- Use the Services to assess another adult without their knowledge and consent
- Copy, reproduce or redistribute our proprietary Content (as defined below), including text, graphics, software code and user-interface designs
- Reproduce or redistribute the questionnaires beyond the personal use permitted by their authors' licenses
- Use the Services or Content to create competing services, or for commercial purposes without a license from us
- Use our trademarks, logos or brand names without written permission
- Interfere with, disrupt or attempt to gain unauthorized access to our servers, networks or infrastructure
- Reverse-engineer, decompile or extract source code from the apps
- Upload, transmit or distribute viruses, malware or other harmful code
- Use automated tools to send reminders to numbers or addresses that are not yours
- Use the Services to facilitate or engage in illegal activity, or attempt to exploit bugs or vulnerabilities
We may block devices or networks that threaten the Services and may pursue legal action for damages caused by technical interference.
Features of the Services
Questionnaire. The app presents the questionnaire in its validated wording. You may pause and resume, and you may leave without saving.
Results. The app shows your score, the result band and an explanation, and, where the questionnaire's published scoring supports it, a breakdown by area. Explanations are general information about score ranges and are not tailored medical advice.
History. Where retaking the questionnaire is appropriate, the app shows your scores over time. Changes in your score are informational and should be interpreted with a professional.
Related questionnaires. The app may suggest other Screening Apps whose subject commonly overlaps with this one. These suggestions are based on the questionnaire you took, not on your answers, and are not clinical recommendations.
Export and sharing. You may export your results as a PDF or image, email them, or share them, for example with your clinician. Sharing may reveal sensitive information about you. You are responsible for the consequences of sharing your results with third parties.
Diary and notes. Some Screening Apps let you record entries between questionnaires. These stay on your device.
Notifications. We may send push notifications for reminders you set, for important updates to the app, and occasionally to ask you to rate the app. You can turn them off at any time.
Licensing and Ownership Rights
Our Content. All materials available through the Services, including text, graphics, illustrations, explanations, software and design (the "Content"), are protected by copyright and other intellectual-property laws. You may not reproduce, distribute, modify, create derivative works from, sell or publicly share our Content without authorization. Export features do not change this; they allow you to use your own results, not our Content, outside the app.
The questionnaires. Each questionnaire is the work of its authors and is used under the terms they have published. Authorship and license information for each questionnaire is shown in the app's About section. The questionnaires are provided for personal, non-commercial use within the Services.
Ownership of the Services. We own and control the Services and their underlying technology. You may not reverse-engineer them, sell or transfer access to them, or use our materials to build competing products.
Copyright infringement reports. If you believe copyrighted material has been used without authorization in the Services, contact support@elomia.com with details and evidence of ownership.
Your Submissions
Your answers, results, diary entries and notes ("User Submissions") are yours. They are stored on your device and are not transmitted to us. Because we never receive them, we claim no license over them and cannot access, review, restore or delete them on your behalf; you control them entirely through the app.
If you send us feedback, suggestions or support messages, you grant us a non-exclusive, worldwide, royalty-free license to use them to operate and improve the Services.
Fees
The Screening Apps are free. We do not sell subscriptions, in-app purchases or paid features in the Screening Apps. If we introduce paid features in the future, we will update these Terms and clearly disclose the price before any purchase.
Important Limitations and Disclaimers
We cannot guarantee that the Services comply with the laws of any jurisdiction outside the United States. You are responsible for determining whether your use of the Services is lawful where you are, and you assume all risks of using them where such use is restricted.
Warranties. The Services and Content are provided "AS IS," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and without assurance that the Services will function without interruption or error. While the questionnaires are established instruments and we take care to present them and their scoring accurately, we do not warrant the accuracy, completeness or suitability of any score, explanation or suggestion for your individual situation. Some states limit how long an implied warranty lasts, so parts of this disclaimer may not apply to you.
Limitations of liability. To the fullest extent permitted by law, Elomia Health, Inc., its affiliates, employees, agents and partners are not liable for any damages or losses arising from your use of the Services, regardless of legal basis, including:
- Indirect or consequential damages: loss of profits, goodwill, business interruption, device failure, inaccurate results, or any indirect, special, incidental, punitive or consequential damages
- Decisions or actions you take based on a score, explanation, trend or suggestion in the Services
- Unauthorized access to your device or to results you have exported or shared
- Loss of data stored on your device, including through deletion or uninstallation
Because the Screening Apps are free, our total liability to you will not exceed one hundred US dollars ($100) or the minimum amount permitted by applicable law, whichever is greater.
Additional terms for international users. The Services are designed primarily for users in the United States. If you use them elsewhere, you do so voluntarily. Where applicable law does not permit certain exclusions or limitations, our liability is limited to the minimum extent required by law.
If you are a California resident. You waive California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Indemnification
You agree to defend, indemnify and hold harmless Elomia Health, Inc. and its contractors and employees from any claims, damages, losses, costs and liabilities arising from your use of the Services, any information you submit through them, or your breach of these Terms. We may assume exclusive control of the defense of any such claim, and you agree to cooperate with us.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms to affiliated companies or to a successor.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles.
Disputes must first be addressed through good-faith negotiation, initiated by written notice; the parties will have sixty (60) days to resolve the dispute. If negotiation fails, the dispute will be settled by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, conducted in Dover, Delaware, and completed within 120 days unless extended by mutual agreement. The award may be entered as a judgment in any court with jurisdiction. We may seek immediate injunctive relief in any competent court to protect our intellectual property or confidential information.
By agreeing to these Terms, you waive your right to participate in class-action lawsuits or class-wide arbitration against Elomia Health, Inc.

Your Data and Privacy
These Terms and our Privacy Policy together constitute our complete agreement with you. The Privacy Policy explains what little data we collect, how we handle it, and your rights.
Changes to These Terms
We may change these Terms as we improve the Services. We will post updated Terms here with the revision date at the top and keep a log of previous versions at the bottom of this page. If changes materially affect your experience, we will notify you by push notification in the app or, if you have given us an email address for reminders, by email. By continuing to use the Services after changes take effect, you accept the updated Terms. If you do not agree, please stop using the Services and delete your data in Settings.
